Assault
Assault is a volitional act with the requisite intent to cause immediate apprehension of a harmful or offensive touching. The discussable elements within assault are the 1.) volitional act 2.) requisite intent 3.) causation and 4.) immediate apprehension of a harmful or offensive touching.
RULE STATEMENT
An assault is a volitional act with requisite intent which causes immediate apprehension of a harmful or offensive touching.
The first issue is whether there was a volitional act. A volitional act is one in which the D performs voluntarily. (INSERT ANALYSIS) Therefore, this requirement is/isn’t met.
The second issue is whether D intended to cause the P to be in apprehension of an immediate harmful or offensive touching. The actor must actually intend to cause apprehension or must be substantially certain that such contact would occur. (INSERT ANALYSIS). Therefore, this is/isn’t met.
The third issue is whether the P caused the D to be in apprehension of a harmful or offensive touching. Assault requires immediate apprehension that contact with the person or something closely connected to the person will occur. Such contact may be direct or indirect. (INSERT ANALYSIS). Therefore, this is/isn’t met.
In addition, the defendant must actually be apprehensive of a harmful or offensive touching. (INSERT ANALYSIS). Therefore, the harmful or offensive touching is or is not met.
